Miss Slinor Moorehouse of the Helooation Section Is here and from general observation in the dining room there appear to be somewhere between five and fifty other paratroopers in the Center, So far I have had no contact with them* 4* Cooperative Snterprlsea! I have carried on some ooorespondence for the last couple of months to arrange for counsel in the Faye Watanabe case* Mr., Walk referred me to Mr* Fleischer, and Mr* Flelshher has now reviewed the case and has made a definite proposal of representation. The Go-op Board of Directors is considering the matter, and will let me know soon whether or not they wish to go ahead. Mr. Flgischer*s proposal is to handle the matter on the basis of a ¢150 retainer and a percentage of all amounts collected* The Co-op is. of course, to advance costs and expenses in_ eluding such expenses of investigation as may be necessary to find Miss Watanabe. I have not been able to get the Maryland Casualty Company to reduce its minimum premiujn on the workmens 1 compensation policy. My brother in Los Angeles got a oomrait-ment from another company to write a policy on the basis of a minimum annual wage per employee of $750 Instead of the $1500 basis on which the Maryland policy is written. However short terra cancellation on the Maryland policy requires ?。方 of the annual premium for cancellation after six months, and the Cooperative people figure that there would be no saving to cancel tliat policy now and write a new one on the lower basis• When the present policy expires, It can be replaced by a new policy on the lower basis* The Co-op has been declaring refunds on the tot<^al amount of its sa'vlngs and holding back a reserve of of each member's share. When a member has withdrawn, his share of this reserve has been returned to him. I have advised that 10涔 of the aavings should be set aside to the reserve before any refunds are allocated to the members, and that no refunds should be made from the reserve until final liquidation. 5* Post SxoXuslon Situations I wi»ote you separately since the week ended about the PMO rejection of five men who made applications for T〇〇ele and who were considered by those who 3tn〇w them here to be surely entitled to work there or in any other place so far aa their characters and records are concerned. I mentioned specifically one man who worked in this office for a long time# Another of these men had Mr. Edwin S* ^erguson worked here for a considerable period before I oame here# Another one was Frank Yasuda who is the Secretary of the Block Managers* Assembly, Executive Secretary of the Co-op, and Executive Secretary of the CACA# Mr. Yasuda attended the 3an Francisoo meeting in January, and you may have seen some reference to him in the accounts of that meeting. I am also Informed that one of the residents who applied for worlc as a draftsman with one of the aircraft companies in Los Angeles as been rejected, and that a question has been raised by the Provost Marshal General about the employment of on© of the men who went down to work with Dr• Emerson at Cal Tech on the gxiayule experimentation project* Thin含s like "this I think have a very positive effect toward retarding general relocation, and particularly toward retarding the return of people here to their homes In Califs oornia. Additional discouraging things are the reports of the outrages In Fresno and indications that the people will have difficulty In getting insurance in California or that their existing insurance policies may be cancelled. Overshadowing all of these negative thing?? Is the Army1 s exolusloii and detention policy whloh continues materially to affect directly or indirectly probably 2^000 residents of the center. An 〇f these things, of course, Including the exclusion and detention policy, negatively affect the confidence and ambition of many people who are not directly affected «lther Individually or through their relatives and family members. X have previously rather vigorously expressed my views on this Army policy and I do not think that there Is much to be added except periodically to emphasize the harm that it is doing In Its effect and the additional harm that is effected by the uncertainty as to Just what the Army*s policy and program is, and the delay in consumatlng whatever that pi^ogram may be* ^here are here a very substantial number of welfare problems—-the aged, the 111, the incompetent, and the impoverished. They had Issued notices to only five men and they set only one hearing for ea〇h day. As I understand it they have left now to review their 冒ork and to formulate their pian for future hearings. Ferguson Solicitor War Relocation Authority 722 Barr Building Washington 25t D. Cf Dear Ed: This will be ay report for th© period beginning Hay 1# J 1945> and ending on May 28t 1945. During this period I have written to you about vai»ioua matters# Including th© Social Security question in the oaee of T-keyoehl Arikawa, the stamp tax on the Co-op Membership Certificates* and the new Selective Service questionnaire. During the period we have had 160 Interviews with evacuee clients, and we have given notarial assistance In 76 other cases• Six of the Interviews concerned domestic relations, 4 Selective Service, 5 taxation» 5 insurance,17 r«?al and personal property, 7 foreign fundg control,1,a bank account withdrawal,SI5 claims for money dde, 2 Social Security, 3 alien registration,13 release from parole,10 repatriation, 3 Immigration and deportation problems,1,a family allowance, 4 misoellaneous, and 5B problems of excludeee and detainees. wrote 148 letters &nd merooranda and t>repare<3 14 affidavits and other doouments* The attachments 冒111 follow by ordJLnury mall* As usual X think they pretty wall outline the work that we have been doing* There seera to have been no problems which obviously require reference to yout and therr have been no unusual speciflo problems which would be of general interest. Mr. Provln«e was her© for a short time and Dr* Pressman has been here twice, Miss Oertrude 谀2ol was here briefly as were Mr• Dirrlcksont of th© Relocation Staff, and Mr* James of Internal Security. I have seen other visitors going in and out but I did not meet them. I will answer y6ur letter of May 16 separately at the first opportunity. (l)Since Debeiaber 17 the major portion of the work of this offioe has been concerned with th© problems of the exeludees and detainees here, and the period of the Iasi fowhas been no exception, You will fiad among the attachmente a nurober of letters to the Commanding General> written for men in this Mr. Edwin S. Ferguson Page 2 June 1» 1945 group• During the first four months after the revocation was announced, we assisted in the preparation of 斑ore than 89 appeal statements. Some of these were sent by mail to the Commanding General but 斑ost of them were held here for presentation to the Board of Officers* In some of these oases the merger© cleared without a hearing, and the etatements were never used* Lately I have b^en writing letters for them to mail at once to the Commanding General, In some oases the men have been cleared after the letters were written without a hearing, but I oan-nct know whether or not either the statements or the letters do any good* I think that the first objectire In suoh cases should be a clarification of the Important facts* This should be sou^it by thfs Army and should In most oases be an advantage to the exclude©♦ I have tited to encourage the to write their own letters but I have had no success at all in this. Ap-purently the great majority need «L«fsistano# either 3Ln clarifying their ideas or in presenting their Ideas and the other facte of their oases、 It seems that we can do no less than give the® this type of aselstanoe. Naturally I feeithimrtedandoftendia-eouraged "because I carmot know what are the oharges a^alnat the menf what are the Issuest or what is the effect of what I do# Colonal Smith was the Chairman of the Board which was here last week* He Indicated that the state-mentis presented by the men 曹ere obviously the work of 8〇ia6〇ne else» and that h# thought that they had little or no value* This oould be said about pleadings filed in any court and could be said arbout most d8p〇8lti&ns« My view 3Ls that a aworn written statement should be accepted as evidence and should be a valuable si8 >or cross exaffiination in order* that the Board aie*ht get at all of the facts in the case. It seems to me that It should have probative vahe even though it may concedediy have been prepared by someone other than the respondent, unless the st;atenientJs made tJherrein are corvtrsidieted ox* iffip©aclidd by cross examination of the respondent or by other evidence intooduced at the hearing. If one of these exolusion cases should be reviewed by a court on th© record^ I am sure that a sworn written Mr. Edwin £• Ferguson Page 3 June 1» 1946 statement would be given suoh effect* If the Armj 寶ere properly advised,I thinlc it 寶ouldl give & 理irom 8tatem@ntsuoh6ff6〇t* So far» the exolueion orders as to detainees have been oonflrmed in only two oases* Th❶8❼技r# th# cages of Tom Takamatsu and Victor Bhlgeyoshi Xnouye* There ax*e several oases already heard as to which there has been no notice of the decisions. Changes on the lists continue to ooa© through every few days* Many of the changes made are fro® List 3 to L»ig1:6• So斑© are fro® List 3 to L隻81; 4• and odoaslonally a roan im changed fro® some other Hat ^0 31* 3 # The Board has so far iset here on four oooaelons* Colonel Lincoln was the chairman at the first three sees ions t and Colonel Smith was the ohalman at the fourth session. In a previous report# I told you about the first &ee ion $ and I belleva that I hare also described the proo®edlngs In the session whtoh began on i|>ril10. Five men w#re heard during the week of May 9* One of these isfin was a Y〇ghio Mura* matsu9 ooneernin客1rho取 I spoke to Mj% Myer and of whom I have previously written to you. Huraisa^u has always been on List 4f but everyone here ie particularly Interested In hi® because of hie military as a volunteer, and becau癟e of his e段rnetst» ness and sincerity. A decision In his case has not yet been given. It rill be a great dleappointaent if his exoluBlon le oonflra#d» Tea men were heard Ihiring the session which Iregan on May 22 and ended on 26» One of the sen heard la sought by the Office of War Information and appears to be e«p«eially qualified for that type of work. There has fro斑 the first been no serious crlt&olfsm of the members of the Boards here as Individuals* My fundamental oritiGisaa 0011timing to be that; the whole procedure Is Illegal so far a& the element of dstentiori is oondernedU la possibly Illegal aa to oitixens under the procedure followed so far as exclusion is unearned* and le not only unfair but also Mr* Edwin i# Ferguson Pa^re 4 June 1| >1945 lnefflolent and unreal! (itlo because as It seems to me It Is not based upon a thorough study and coo* plete knowledge of the whole program» is not aup~ ported by a sound consistent purpose, and will not accomplish solely or at all the only Juatlftable purpose it oould have* that is, to prevent espionage and sabotage by excluding from orltloal areas p«i>» sons irho surely or prob技fcly would oomadt 8110h aots if they had opportunity. To put It another way both th« criteria and the procedure being used seem to me to result in no more than so Jumbb i of alfflout arbitrarily listing people in various ways and In oomplloated fashion, and then aioving th^ia back and forth from on© Ust to another with no sound reason for believing either that the persons excluded are dangerous or that all of tht persons oloared are perfectly haralees, 1 have read Miss D©斑v费!》y 〇ar®ful】y and with gre&t interest• I think th段t it is certainly a valuable oontrlbutlon to the thought on the whole subject* The articl® was appar哼ntly 曹きn without reference to the present exclusion policy, but fliueh of he^nalysisifis very 田uoh In point on that polioyf particularly her discussion of the military prooedure on pages 230 and 231. (2) Mr. Alex r»pnansco, fro® the Offioe of the San IVaii-cisco Collector, was here on Monday to go over the Go-op tax returns. He was afraid that he was run-111ng into & 斑ess which vsould take at le&st a 冒eek to unravel bwt an hour^ work iaas sufficient. The only thing which had to b© taken care of wae the excise tajl for 1943 and the old age tax for 1942. The Co-Op had been nware of this delinquency and had set up a reserve for the purcoee. The whole delinquency oame to about #5CX) with penalties and interest. All other tax returns seemed to be In good shape» and all taxes due to have been paid* (2) Relocations On January 1 of thi« year th#re wwre 5586 residents of Hant&naQ Including those absent on leave* The comparative figure for Hay 31 is 4679, showing the ntt loss of 907* {Helooatlon would use the phrase ^showing the net gain of 907.**) This i« fairly Jr Mr» Edwin Ferguson Page C June 1,1945 oouraging, but oTrvlouely the task ahead Is a big one. School will close this week, and the expectation Is that there will be a very substantial \ exodus during the next; three months. The deterrant ! faotors which come most often to my attention are the exclusion and detention lists» the parole si- ^ tuation9 and the bad reports from many of the west coast areas* So far I hava heard nothing of any real substance unfavorable to Los Angeles or to th* Metropolitan centers» except the fact that housing opportunities are often not available to evaouees except in domestic workf gardenlngt similar lines* A good proportion of the people come from the cities, but there are many of them who oame from farms and truck gardens. The reports from the rural areas> particularly in the S&n Joaqutn Valley, are certainly most discouraging, and I think that they tend to discourage people from returning to rural areas ©ven in southern California. No one can fairly feel anything but disgust 窥nd so取 e if ox* boding when he reads about such a thing as the Doi verdict and the ridiculous sentence given the man who pleaded guilty to firing shots Into an evaou«e*e home. Personally I think that th©x*e is some fine talk coming from California offioi&ls who hare not intention of really doing anything about the situation until they are forced into It* If it is possible to circulate K©nt*s report on the Dol oase among the project attorneys, I should be very Interested to read It* One of the prize quotations to oo®e out of Galifornia recently I think is the statement made Dis- triet Attorney of Fresno County that there ape two reasons for the acts of violence to returning evacuees. This might be paraphrased accurately as folio胃sj that thei*© are two classes of people responsible for shoot-ings, those who do the shooting and those who think that there should be no shooting. (4) My brother in 3-os Angeles has written soma fire Insurance on property owned by people ol*. In 1914 he returned alone on a Japanese passport* He went back to Japan In 1919 and again in 1924, each time 〇|i a Japanese passport* His school record indicates that he was born in Japan, and no record to th© contrary was made until the eiracuatlon. Not until 1939, when his father retxirned to ^apan, was Haeda told that he actually was bom in the United Spates* Under an attorney^ advice he reglstored as an alien in 1940, eichiblted his Japanese passport, and apparently was registered as having been born In Japan. H© registered as an alien enemy In 1942, and at that time stated that he was bom In California* Ho reoord of his birth w 8 made at the time. The house in which he was born is gone. His parents are both in Japan, and wbvionsly there Is only a remote possibility of finding witnesses who can testify to the fact of Ms birth In this country. Since his parnets are In Japan, he Intends to visit there after the war, and he would of course be much better off If he could travel on an American passport, I see nothing which could be done for hlm> except by means of a petition to establish the fact of hie birth In California. There Is quite a bit of evidence against Ms claim and practically none available In support of it.
